Can SPAK be improved by our political class?

There is a broad consensus in public opinion that SPAK can be improved, even though its achievements in the fight against corruption are evident. There are many legitimate concerns about the way SPAK has acted, from the constitutionality of wiretapping and phone seizures to witness intimidation and pre-indictment arrests.
These are concerns that essentially seek to balance the fight against corruption with respect for the fundamental rights of those under investigation, especially those public officials who do not enjoy the political, media, and financial support of the big fish.
Although the media's attention is on political VIPs, SPAK's problematic arrests are much more frequent at the lower and middle levels of public administration. There are many cases of individuals at lower levels of public administration who have been abusively arrested by SPAK's anti-corruption zeal.
Of course, accepting the improvement of SPAK does not mean agreeing with its reform, as the SP is demanding, and even less supporting its elimination, as Berishism claims. The idea that SPAK should be reformed and not improved implies that this institution has failed.
A failed institution is reformed while a successful institution is improved. And despite the criticisms that may be made of SPAK, in the eyes of most Albanians its success is undeniable. Therefore, it can be improved but not deeply reformed, as it is the product of the reform of the old justice system, which had completely failed in the fight against corruption.
The question arises, who will improve SPAK and the new justice system? At first glance, the answer is simple, parliament has the constitutional authority in this area because we are a Parliamentary Republic.
The problem is that the Albanian parliament is, and will most likely continue to be, a showcase for our old political class that is in deep conflict of interest with SPAK because it is being investigated by it. The most flagrant example is of course the case of Berishism, which has now been reduced to a political movement to close SPAK's investigations into the Berisha family.
A similar conflict of interest exists in the case of the SP, although less blatant than in the case of Berishism. The Socialist Party and Prime Minister Rama declare the urgent need to reform SPAK precisely when its investigations strike at the heart of the socialist government.
The SP's calls to put SPAK on constitutional tracks and to depoliticize the new justice system sound dubious when articulated after the arrest of Mayor Veliaj. Even more so when his arrest was neither more violent, nor more anti-constitutional, nor more political than previous SPAK arrests.
Akuzat e SPAK ndaj Veliajt mund të rrëzohen nesër në gjykatë ama ato nuk janë më pak serioze dhe më pak të faktuara se sa akuzat e këtij institucioni ndaj Metës apo Berishës. Shumica e gazetarëve dhe një pjesë e mirë e ekspertëve ligjor që e kanë studiuar me kujdes këtë dosje dëshmojnë se bëhet fjalë për një hetim serioz që nuk merret thjesht me lodra kalamajsh.
Nga ana tjetër arrestimi i Veliajt nuk është më politik se arrestimi i Berishës, dhe as më i dhunëshëm se arrestimi i Metës që u tërhoq zvarrë në mes të rrugës. Goditja politike që SPAK i ka dhënë LSI/PL dhe berishizmit është shumë më e madhe se goditja politike që ka marrë PS-ja me arrestimin e Veliajt.
E megjithatë as në rastin e Berishës dhe as në rastin e Metës PS-ja nuk është shprehur kundër dhunës apo politizimit të SPAK. Ndaj shqetësimi i papritur i kryeministrit Rama dhe i kampit socialist me kushtetueshmërinë, dhunën dhe politizimin e SPAK-ut është i dyshimtë. Sidomos sot kur ata janë në konflikt të hapur interesi me këtë institucion.
Në këto kushte shtrohet pyetja: Nëpërmjet cilit legjitimitet do ta bëjë reformimin e SPAK e njëjta klasë politike që është vënë në bankën e të akuzuarve nga ky institucion? Me legjitimitetin që vjen nga vota e popullit, do ishte përgjigja e klasës sonë politike.
Ama të gjitha sondazhet tregojnë se përsa i përket luftës anti-korrupsion qytetarët shqiptar kanë shumë më besim tek SPAK dhe drejtësia e re sesa tek partitë politike. Aq më tepër kur këto të fundit e kanë monopolizuar skenën politike duke e bllokuar tërësisht rinovimin e saj.
Rama ka monopolizuar PS-në duke eleminuar çdo mundësi për rinovim brenda pushtetiti socialist, ndërkohë Berisha ka privatizuar PD-në duke eleminuar çdo mundësi të rinovimit opozitar. Në një sistem thellësisht bipolar kjo e ka reduktuar rinovimin e politikës tek parti të vogla që janë në periferi të hapësirës politike dhe mediatike. Nuk është çudi që shumica e qytetarëve nuk janë të kënaqur me asnjë nga partitë politike tradicionale.
Partia Socialiste është, dhe do vazhdojë, në pushtet jo sepse shumica e shqiptarëve është e kënaqur me qeverisjen e saj por sepse kjo shumicë urren më shumë alternativën berishiste. Ndërkohë berishizmi do vazhdojë të mobilizojë atë pakicë të elektoratit që urren me shpirt Ramën më shumë se Berishën.
Në këto kushte përmirësimi i SPAK nuk duhet, dhe nuk mund të jetë, prioritet i klasës politike shqiptare. Problemet e Shqipërisë dhe problemet e klasës sonë politike janë shumë më serioze se sa problemet e SPAK-ut.
Kjo e fundit ka, gjithësesi, disa mekanizma të brendëshëm kontrolli dhe balancimi mes shkallëve të ndryshme të saj, Prokurorisë së Posaçme Kundër Korrupsionit dhe Krimit të Organizuar, Gjykatës Kundër Korrupsionit dhe Krimit të Organizuar (GJKKO) dhe Gjykatës së Apelit për Korrupsionin dhe Krimin e Organizuar. Pa përmendur mekanizmat gjygjësor që ekzistojnë jashtë SPAK.
Nothing like this is found within our political parties where power is concentrated entirely in the hands of the boss, without any internal or external mechanism of control or balance. Trusting these institutions, deeply corrupt and anti-democratic, to reform the most successful anti-corruption institution in the history of the Albanian state is like hanging the livers on the neck of a wolf. Especially today when the West is too paralyzed by the Trump disease to guarantee the improvement and not the deformation of SPAK./ Lapsi.al
