The constitution of the Kosovo Assembly is in limbo! REL Analysis: Are we heading towards an institutional crisis?

The eventual continuation of the opposing and rigid political positions of the Vetëvendosje Movement on the one hand, and the three parties that have been in opposition until now, the Democratic Party of Kosovo (PDK), the Democratic League of Kosovo (LDK) and the Alliance for the Future of Kosovo (AAK) on the other, could block the process of constituting the Kosovo Assembly, say experts on political developments in Kosovo.
The Kosovo Assembly failed on Tuesday to constitute the composition of the new legislature, which emerged from the parliamentary elections held on February 9.
The elected deputies failed to pass the first item on the agenda, the approval of the report of the Temporary Committee for the Verification of Mandates and Quorum.
PDK, LDK, and AAK voted against the report because, according to them, the members of the incumbent Government - who were elected MPs - did not submit their resignations from executive positions on time, as required by the Law on Government.
Article 26 of this law stipulates that members of the executive, who have been elected deputies, must resign from their executive positions one day before their certification by the Central Election Commission.
Albin Kurti, the leader of the Vetëvendosje Movement, which won the elections, on April 15 sent the speaker of the previous legislature of the Assembly, Glauk Konjufca, a letter announcing his resignation, which according to him has been effective since March 27, when he notified the CEC that "the executive is in office/resigning."
The CEC certified the election results on March 27.
Are we heading towards an institutional crisis?
Vullnet Bugaqku from the Kosovo Democratic Institute (KDI) tells Radio Free Europe that the reaction of the parties that have been in opposition until now was legitimate, because the elected deputies, who were members of the executive, did not resign according to the law.
" The question arises as to in what capacity they came to the Kosovo Assembly, knowing that the mandate of a deputy, according to the law in force in Kosovo, begins from the day of the certification of the elections ," Bugaqku emphasizes, adding that all those elected deputies should have offered their public resignations from executive positions in a timely manner.
The Rules of Procedure of the Assembly of Kosovo state that if the session for the constitution of the legislature is interrupted, the interruptions "may not be longer than 48 hours."
Bugaqku says that the continuation of the constitutive meeting is expected within this deadline and it remains to be seen whether the political parties will pass the mandate verification phase, to reach the swearing-in of the deputies or, on the contrary, will remain in their current positions.
“Atëherë lirisht mund të konstatojmë shkojmë drejt një lloj krize, për arsye se nëse nuk kalon në këtë fazë raporti i Komisionit për verifikim të mandateve, nuk do të arrijmë as deri te dita e propozimit të kandidatit për kryetar të Kuvendit, e që paraprakisht nuk do të jemi as në situatën e dhënies së betimit të deputetëve”, thekson Bugaqku.
Ai shton se KDI-ja u ka bërë thirrje deputetëve të partive politike, në veçanti atyre të partisë më të madhe parlamentare, Lëvizjes Vetëvendosje, që të ndërmarrin të gjitha hapat e nevojshëm për konstituimin sa më të shpejtë të Kuvendit.
Besar Gërgi nga Grupi për Studime Ligjore dhe Politike, thekson për Radion Evropa e Lirë se mungesa e vullneti nga deputetët e zgjedhur të Lëvizjes Vetëvendosje, që ishin pjesë e ekzekutivit, që t’i përmbushin kërkesat ligjore, por edhe mungesa e vullnetit të partive, që deri më tani ishin në opozitë, për të ecur para me procedurat teknike, e kanë sjellë procesin e konstituimit të Kuvendit në vendnumëro.
“Pra, tashmë kemi hyrë në një proces që ka rrezik të zgjasë me disa javë të tëra, pasi që fatkeqësisht as Kushtetuta dhe as ligji nuk i saktësojnë në detaje procedurat që duhet të ndiqen, në rast se këto afate ceremoniale [jo më shumë se 48 orë ndërprerje të seancës] nuk përmbushen. Nuk ka një kufizim se sa [afate] 48 orë janë. Hipotetikisht, do të ishte e pafundme”, thekson Gërgi.
Sipas tij, partitë parlamentare duhet të sigurojnë një mirëkuptim politik, për të arritur te përfundimi i procesit të konstituimit të Kuvendit.
Rehati për përllogaritje politike
Ministrja në detyrë e Punëve të Jashtme të Kosovës, Donika Gërvalla, e cila po ashtu ka fituar mandatin e deputetes në zgjedhjet e 9 shkurtit, ka paralajmëruar krizë institucionale.
Në një paraqitje në televizionin vendor, TëVë1, Gërvalla ka theksuar se përsëritja e votimit të raportit të Komisionit të përkohshëm për verifikimin e mandateve dhe kuorumit, nuk parashihet me dokumente dhe Rregulloren e Kuvendit të Kosovës dhe se tashmë procedurat janë ndërlikuar.
“Kemi arritur në një pikë ku mund të jetë tërësisht e pamundur të vazhdohet konstituimi i këtij Kuvendi”, ka thënë Gërvalla.
Por, Gërgi shpreh mendimin se vendnumërimi në procesin e konstituimit të Kuvendit, u krijon një rehati edhe Lëvizja Vetëvendosje, por edhe partive që deri më tani kanë qenë në opozitë, që të përllogarisin mundësitë për krijimin e shumicës parlamentare.
Aktualisht, sipas tij, as Lëvizja Vetëvendosje dhe as partitë, që deri më tani ishin në opozitë nuk e kanë këtë shumicë, e cila do të hapte rrugë jo vetëm për konstiuimin e Kuvendit, por edhe për formimin e Qeverisë së re.
“Është saktësisht blerje kohe nga të dyja palët, sepse në qoftë se do të themelohej legjislativi, atëherë kronometri do të fillonte të numëronte dhe do të kishte 15 ditë për Lëvizjen Vetëvendosje për të themeluar një qeveri”, thekson Gërgi.
He adds that even the parties that were in opposition last term are buying time to calculate possible options among themselves for forming a parliamentary majority.
This is due to the fact that if the Vetëvendosje Movement fails to form a Government within 15 days, then the country's president, Vjosa Osmani, can mandate the second party with the most votes - in this case the PDK - to secure, together with other parties, 61 MPs to vote for the formation of the new Government.
But, Bugaqku considers that the only way to avoid blocking the process of constituting the Assembly is for the members of the current Government, who have won the mandate of MP, to present publicly, but also before the chairman of the constitutive session of the Assembly, their resignations from executive positions.
" Then we return to the session and there everything can go according to regular procedures, because there will be no dilemma or suspicion if any MP is exercising the dual mandate of both a member of the Government and a member of the Assembly of Kosovo. This is the only solution, otherwise we will get stuck in this situation ," says Bugaqku.
He adds that in the event of a stalemate in the process of constituting the Assembly, it does not create any other space for political action by political entities, or even for new early parliamentary elections.
The continuation of the constitutive session of the legislature, according to the Rules of Procedure of the Assembly, must take place no later than Wednesday, when the 48-hour deadline for the interruption expires. /REL
