Law changes/ Builders of seized buildings are no longer allowed to buy them back

The government has amended the law on the administration of buildings seized by the state that were built without a permit. In the new draft law approved at the last government meeting, builders who have built these buildings without a permit or in excess of it are prohibited from buying them back.

Three years ago, the government passed a law that gave it the right to confiscate buildings built without a permit or those that exceeded the area provided for in the building permit by more than 10 percent.

As a result of this law, the state confiscated dozens of buildings, mainly in Tirana. Among them, two buildings were built by businessman Lul Morina in the Liqeni i Thatë area completely without a permit, another by Pëllumb Salillari in the same area, while Armand Lilo's Eyes of Tirana tower, which had several additional floors above the approved permit, was taken away.

But after the confiscation by the state, all of these buildings were put up for sale and bought back by the people who had built them at ridiculous prices of around 200 euros per square meter.

The law of three years ago was argued by the government as a measure to stop high-rise construction without permits. But because builders were buying back the buildings built in violation of the law, at ridiculous prices, the law not only failed to curb illegal construction, but actually increased it, since through the purchase by the state, illegal construction was legalized.

To curb this phenomenon, the government has decided to change the law by no longer allowing builders to participate in auctions for the sale of seized properties.

"Subjects, in the capacity of developer/implementer/supervisor/inspector of confiscated property, do not have the right to participate in the sale procedures," the new draft law states.

This clause will have a transitional period of 6 months from the entry into force of the new law. Beyond that, the new draft transfers all administration of seized objects to the Agency for the Administration of Seized and Confiscated Assets.

This agency will have the right to determine the destination of the seized objects by deciding whether to use them for public purposes or put them up for auction for sale.
