District Prosecutors' Offices ultimatum to the Ministry of Finance: Send us your salaries by 4:00 PM, or you will face the law!

The institutional conflict between the judiciary and the executive over the issue of August salaries has reached critical alarm levels, surpassing administrative discussions and moving into warnings of criminal prosecution.

During a detailed report, journalist Arsen Rusta stated to MCN Live that the so-called third pillar of power is waging an open battle with the government, as the deadline for resolving the financial impasse expires today at 4:00 PM.

The situation has escalated significantly at the district level, where prosecutors are preparing the first legal steps against Ministry of Finance officials if the payment orders are not executed within the deadline set this afternoon.

"We learned today that some prosecutors, such as the one in Fier and the one in Elbasan, have officially addressed the Treasury Directorate, making it clear that every minute that salaries are delayed constitutes a serious criminal offense. According to them, this artificial blockage leads directly to the consumption of the elements of the criminal offense of abuse of office, while the deadline has been set at 16:00, after which time criminal liability will be sought, where it remains to be seen whether this liability will fall on the technical structures or on the Minister of Finance himself."

Another worrying element brought to light by this reporting is related to the stance of the private banking system, which seems to have found itself caught between two institutional fires, having been unofficially ordered to freeze the disbursement of funds. Reconstructing the scheme of what is happening behind the scenes with the magistrates' accounts, the journalist testified that:

"The response received from second-tier banks proves that they have had a purely verbal communication not to pay the salaries of magistrates, which clearly shows that private banks have been put under pure political pressure not to implement the law and the spending orders issued by the relevant institutions."

For its part, the Ministry of Finance defends itself with the argument of the lack of a new legal framework voted in Parliament, not recognizing the right of the high councils to dictate the budget distribution without the approval of the executive. Meanwhile, the Constitutional Court had set a deadline of July 30 for the Parliament and the Government to draft and vote on a new law on the calculation of magistrates' salaries, which was not implemented as the new draft law has remained simply in the draft stage.

"On the other hand, the judiciary has spoken about the right acquired through a constitutional decision, which stated that by July 30, the Parliament and the Government should make a new law to calculate the salaries of magistrates. However, Finance says that the Supreme Court and the Supreme Administrative Court cannot impose obligations on us, since the only institution that imposes this legal obligation on us is the law and as long as there is no new law, we will continue to implement the old law."

Beyond the current impasse related to August salaries, the data provided shows that the system is rapidly heading towards a complete financial collapse in the fall, as funds allocated to the prosecution bodies are rapidly depleting.

"From all the verifications carried out, it results that the country's prosecutors' offices have sufficient budget and finances to receive salaries only for the months of August and September, while for October there are no more funds available, anyway," said Arsen Rusta, implying that if there is no urgent legislative intervention, the justice system will face a total functional blockage within a few weeks.
