The Constitutional Court has ruled on Prime Minister Edi Rama's appeal against the decision of the Special Court (GJKKO) to suspend Belinda Balluku from her duties as Deputy Prime Minister and Minister of Infrastructure.
It is learned that the Constitutional Court has decided to pass the Balluku case for consideration in session.
It is reported that 5 judges of the Court of Justice voted in favor of accepting Edi Rama's request, while 3 others voted against reviewing the issue of the suspension of the Deputy Prime Minister and Minister of Infrastructure.
After this decision, the case will be reviewed in a special session, where the members of the Constitutional Court will judge the merits of the GJKKO decision and decide whether the suspension of Belinda Balluku was in violation of the powers or not.
On the other hand, the Special Anti-Corruption Court (GJKKO) imposed a suspension measure on Belinda Balluku, following the SPAK investigation, which has raised strong accusations against the government's number two for abuses with the Llogara tunnel worth 50 million euros and the pre-determination of the Grand Ring Road tender.

MINISTER'S STANDING Prime Minister Edi Rama did not dismiss Balluku from office after his suspension by the GJKKO, but stripped him of his right to sign and appealed to the Constitutional Court. The government requested that the dispute over competences created between it and the GJKKO be resolved and the decision to suspend him from office be repealed.
The constitutional provision, according to which a member of the government enjoys the immunity of an MP, is the main point on which Prime Minister Edi Rama based his appeal. According to the appeal, as long as the suspension of an MP from office cannot be decided by a court, this cannot happen for a minister either.
The complaint alleges a clear interference in the powers of another branch of government, such as the executive branch, and that the GJKKO has assumed attributes that are not recognized by the Constitution. The government has not appealed the other security measure of banning travel abroad to the Constitutional Court.
On the other hand, Miliana Muça will be the judge in the Special Court of Appeal, which will review the appeal of the security measures requested by SPAK and assigned by the GJKKO for Deputy Prime Minister Balluku and her two subordinates, the director of KESH Erald Elezi, and the director of ARRSH, Gentian Gjyli.
On November 20, the Special Court suspended the Deputy Prime Minister and the Minister of Infrastructure and Energy from office, also banning them from traveling abroad.
It has been named as a defendant for the procedures in the Llogora tunnel tender and is under investigation for the tender for Lot 4 of the Greater Ring Road. In both cases, it is suspected that the winner was predetermined. SPAK has announced that it is also investigating a number of other procurement procedures. Gentian Gjyli and Erald Elezi are also accused of violating equality in tenders for the construction of the Llogora tunnel. Elezi is also suspected for the tender for Lot 4 of the Greater Ring Road.
