"SPAK may request the arrest of a senior official"/ Journalist's strong statement: If Balluku goes to the office, he may be arrested in flagrante delicto

Journalist Klodiana Lala, in her interview on the show "Kjo Javë", explained in detail the decision of the Constitutional Court which upheld the decision to suspend Deputy Prime Minister Belinda Balluku from public functions.
According to her, from the moment the CC announced its decision, Balluku cannot exercise public functions until the CCKO Appeal is pronounced.
Lala said that if Balluku goes to the office and violates the Constitutional Court's decision, he could be arrested in flagrante delicto.

Further, Lala focused on what the CC decision produced, where according to her, since the CC did not consider the CC decision unconstitutional, it gives SPAK the opportunity in any case to go to court and request the suspension of a senior official from exercising his functions.
"So if tomorrow, the president and prime minister will address the CC, I would prefer that this court should have given a final answer, we do not have a definitive answer on this. But since it is not unconstitutional, SPAK is using this moment, that in the event of an investigation against an official, they can address the court for suspension from office," said Lala.
According to Lala, the judicial body for the decision against Balluku was divided 4-4, with the president of the GJK Fjona Papajorgji, Marjana Semini, Sandër Beci and Sonila Bejtja holding the position that Ms. Balluku could not be suspended since she enjoys the immunity of a deputy, so SPAK should have gone to the Parliament to obtain authorization.
"The other 4 judges are Ilir Toska, Asim Vokshi, Gent Ibrahimi and Marsida Xhaferllari. Gent Ibrahimi, in the interim decision dated December 12, he voted for the temporary lifting of Balluk's suspension, so he was in favor of Rama," said journalist Klodiana Lala.

The other 4 judges are Ilir Toska, Asim Vokshi, Gent Ibrahimi and Marsida Xhaferllari. Gent Ibrahimi, in the interim decision dated December 12, he voted for the temporary lifting of Balluk's suspension, so he was in favor of Rama.
