Student protests cause earthquake, Police issue urgent letter: Minors' phones will not be checked without a court order

The State Police has issued an urgent letter addressed to the Tirana police stations and police structures in Kruja, requesting measures to guarantee the rights of minors involved in police procedures, in the context of the recent student protests.

In the document of the Tirana Local Police Directorate, addressed to police stations no. 1, 2, 3, 4, 5, 6 and 7, the implementation of the obligations set forth in the Juvenile Criminal Justice Code and other legal acts in force is requested.

One of the requirements is the clear identification of police officers while on duty, through identification numbers, as well as the identification of police vehicles during operations.

The letter also emphasizes the need for cooperation with relevant structures for the management of cases involving minors, with the aim of avoiding their detention for unnecessary periods and respecting the limits set by law.

Another important point relates to the control of mobile phones. According to the guidelines, the police should not control phones without a court order, while any request for wiretapping must be based on the relevant legal basis.

For each minor, the presence of a parent or legal guardian and a psychologist is required. Also, before the interrogation begins, a form on the rights of the minor must be completed, and a special register must be kept for these cases.

The document requires police structures to recognize and implement legal acts that regulate the proportional use of force and tear gas. It also emphasizes the obligation to complete escort records with all necessary data.

In conclusion, the leaders of the State Police request the correct implementation of all measures set out in the letter, so that police procedures during protests are carried out in accordance with legislation and legal guarantees for the protection of minors.
