Decision that could affect US immigration visas for Albanians
A federal court in Washington has ruled that the Trump administration's policy of suspending immigrant visa processing for citizens of 75 countries, including Albania and Kosovo, is unconstitutional.
In a ruling issued on July 31, federal judge Amit Mehta concluded that the policy known as the “Public Charge Policy,” approved by Secretary of State Marco Rubio, exceeds the powers that Congress has granted the State Department under the Immigration and Nationality Act.
The policy took effect on January 21, 2026, and ordered consular officers to deny or suspend immigrant visa processing for citizens of 75 countries until the State Department developed new procedures for assessing the risk that applicants would become welfare recipients in the United States. The list also included Albania and Kosovo.
In his reasoning, the judge emphasizes that the law reserves the decision-making to grant or deny visas to consular officers, while the Secretary of State does not have the authority to impose collective denials for an entire category of applicants.
The court ordered that the plaintiffs' specific application be reviewed individually within 60 days, but the decision does not automatically repeal the policy for all applicants from the 75 countries, as the case was decided on the basis of an individual lawsuit.
