
Accusations of "Attack on Constitutional Order", Bosnian Prosecution issues arrest warrant for Dodik


The Prosecutor's Office of Bosnia and Herzegovina has issued a warrant to the police to detain the President of Republika Srpska (RS), Milorad Dodik, Prime Minister Radovan Višković and the Speaker of the Parliament of this entity, Nenad Stevandić, for questioning, it has been confirmed to Radio Free Europe.
The arrest warrant for Dodik, Vishkovic and Stevandic was issued by Bosnian Prosecutor Čazim Hasanpahić. They are accused of committing the criminal offense of “attacking the constitutional order”.
The announcement comes on the day authorities in Republika Srpska plan to define the entity in Bosnia and Herzegovina as a state of the Serb people, grant it the right to self-determination, create its own army and abolish the Council of Peoples, according to a new draft of the Republika Srpska Constitution, which Radio Free Europe has seen. These changes contradict the Constitution of Bosnia and Herzegovina.
The Criminal Procedure Code of Bosnia and Herzegovina provides for the possibility of issuing an order for compulsory conduct to provide testimony, in the event that the person summoned to judicial institutions refuses to do so.
The Prosecutor's Office has submitted the detention order to the judicial police and has requested assistance from the Republika Srpska Ministry of Interior and the Investigation and Protection Agency (SIPA), Radio Republika Srpska reported.
The director of the police court in Republika Srpska, Zeljko Dragojevic, told Republika Srpska television that this police does not and cannot issue detention orders because this is within the jurisdiction of SIPA and the Police Court of the Court of Bosnia and Herzegovina.
The National Assembly of Republika Srpska is scheduled to discuss the entity's draft constitution on March 12, marking another secessionist move by the entity's authorities after laws were passed that ban Bosnia's judicial and investigative institutions from operating on the territory of Republika Srpska. The laws came into effect last week.
At a session on March 12, deputies in Republika Srpska are also expected to discuss the creation of a special court and prosecutor's office to "protect the constitutional order."
These unconstitutional laws were enacted after Dodik was sentenced, in the first instance, by the Bosnian Court to one year in prison and a six-year ban from holding the office of president for disrespecting the decisions of the international High Representative.
On February 27, the RS Parliament approved the unconstitutional laws, and on March 5 they were decreed by Dodik.
The ban on the functioning of state justice institutions on part of the territory of Bosnia and Herzegovina is contrary to the state Constitution and on March 7, the Constitutional Court of Bosnia suspended the implementation of these laws.
Dodik has said that the laws will be implemented regardless of the Constitutional Court's decision.
The adoption of these laws has been condemned by senior world officials, including US Secretary of State Marco Rubio, NATO Secretary General Mark Rutte, and several foreign embassies in Bosnia and Herzegovina.
The European Parliament will discuss threats of secession in Bosnia during its plenary session on March 12.
The Constitution of Bosnia is Article 4 of the Dayton Peace Agreement that ended the war in Bosnia in 1995. According to this document, the state can assume jurisdiction “in those matters for which an agreement is reached between the entities.”
Practically, all the powers that the RS authorities want to “return” to the entity level have been transferred to the state level through voting in both houses of the Bosnian Parliament, including the votes of RS representatives.
According to the Constitution of Bosnia, Republika Srpska and the Federation of Bosnia and Herzegovina are entities that constitute Bosnia and Herzegovina and do not have the status of a state. Also, sovereignty and territorial integrity, according to the state Constitution, are reserved only for the state of Bosnia and Herzegovina and not for the entities./REL
