Conflict over salaries with justice, BIRN: Aimed at distracting attention and public debate from daily protests

The conflict over magistrates' salaries turned into a new public clash between Prime Minister Edi Rama and the judiciary, which, according to political analysts, aims to distract attention and public debate from the daily protests.
Prime Minister Edi Rama started the week with a public attack on judges over the issue of calculating their salaries, after the majority he leads delayed the implementation of the Constitutional Court's decision on this issue.
" The history of the world has never seen judges say they will take the money themselves from the state treasury because it is ours, and this "we collected it ourselves" is a separate offense due to the horrifying level of ignorance about the functioning of the state, " Rama wrote on the X platform, commenting on a media interview with the president of the Judges' Association, Engert Pëllumbi.
Judges and prosecutors have been a favorite target for Prime Minister Edi Rama in recent years, despite the various issues he has engaged in debate. In the recent dispute over salaries, the prime minister tried to divert the debate from the obligation to implement a Constitutional Court decision to the high salaries of judges and prosecutors in Albania.
The conflict began after the Ministry of Finance and the State Treasury departments refused to allocate salaries for the month of August for all magistrates in the justice system, according to a new calculation for these salaries made by the Councils based on a decision of the Constitutional Court.
In the Prime Minister's rhetoric, Albanian judges are presented as an overpaid category and further salary increases would constitute a burden on the state budget and exceed salaries tenfold compared to other sectors.
But for political analysts, the prime minister is using this rhetoric to attack the judiciary for political reasons and is attempting to divert 'public hatred', which for more than 100 days has been focused on his government.
Afrim Krasniqi from the Institute for Political Studies told BIRN that the Prime Minister has two goals that are not related to solving the problem, but to parallel agendas.
First, according to him, he seeks to use the opportunity to pressure the judiciary, which has also prompted a denigrating campaign by his militants and followers.
" This is an important indicator in the conditions when SPAK will have to make decisions regarding the immunity of the Deputy Prime Minister, the Zvërnec investigations and other VIP files, " says Krasniqi.

Krasniqi e quan këtë një ‘debat monolog’, pasi kryeministri po ndan komente e shënime publike kundër një sistemi, i cili nuk i përgjigjet sepse është kolektiv, është diskret dhe vepron me akte ligjore.
Ndërsa Neritan Sejamini i konsideron sulmet e kryeministrit ndaj organeve të drejtësisë si një taktikë për të devijuar debatin dhe vëmendjen publike nga protestat e përditshme qytetare që kërkojnë dorëheqjen e kryeministrit.
“Unë mendoj që është thjesht taktikë për të shpërqendruar vëmendjen nga problemet e tij dhe për të krijuar një shënjestër tjetër për të kanalizuar urrejtjen publike edhe diku tjetër përveç tij,” tha Sejamini.
Në muajin shkurt, Gjykata Kushtetuese konstatoi se formula e përdorur për llogaritjen e pagave të magjistratëve kishte sjellë një “ulje të fshehtë” të pagës dhe urdhëroi Kuvendin të miratonte ndryshimet e nevojshme ligjore për përshtatjen e pagave me standardet kushtetuese. Gjykata përcaktoi si afat të fundit datën 31 korrik 2026, ndërsa efektet financiare duhej të shtriheshin që nga 1 prilli 2023. Megjithatë, deri në përfundimin e këtij afati Kuvendi nuk ndërmori ndryshimet e kërkuara, duke lënë të pazgjidhur edhe mënyrën e përllogaritjes së pagave nga 1 gushti e në vijim.
Në muajin gusht, Këshilli i Lartë Gjyqësor dhe Këshilli i Lartë i Prokurorisë, duke interpretuar karakterin detyrues të vendimit, vendosën që të përcaktojnë pagat e gjyqtarëve sipas arsyetimit të Gjykatës Kushtetuese me një pagë bazë referuese prej 222 mijë lekësh dhe 14 mijë lekë shtesë për kualifikimin, si dhe kompensimin e rritjes së munguar që nga prilli 2023.
Në vend që konflikti të mbetej një çështje e zbatimit të një vendimi kushtetues, debati është shndërruar në një përplasje publike mes kryeministrit dhe gjyqësorit, pasi Ministria e Financave refuzoi të zbatonte formulën e pagave sipas vendimit të KLGJ-së duke sjellë si pasojë paditjen e ministrit dhe drejtorëve të Thesarit në gjykatë.
Sipas Krasniqit, kryeministri e shmang pikërisht thelbin e këtij problemi që lidhet me pyetjen se pse mazhoranca dhe Kuvendi nuk zbatojnë vendimet e Gjykates Kushtetuese.
“Respektimi i këtij parimi dhe i detyrimeve kushtetuese do të kishte evituar krizën, debatin dhe koston e qytetarëve për shkak të tyre,” vlerëson Krasniqi.
Nga ana tjetër, Krasniqi vlerëson se KLGj dhe KLP u nxituan në vendimmarrjet e tyre, pa informuar publikun dhe pa ndjekur më parë instrumentet e tjera.
