Explosion in Brryl: Five insurances that fuel traders should know

The fuel explosion in the Brylli area of ​​Tirana brings to mind the importance of financial insurance for high-risk businesses.

Five insurances are important for a gas station in the face of unexpected events: 

1. civil liability towards third parties (compulsory insurance), 

2. personnel accidents, 

3. business property, 

4. missing profit and 

5. environmental responsibility.

Every entrepreneur, fuel trader, and citizen should be familiar with each of these insurance policies, so that the amortization/minimization of financial damages from an accident similar to the explosion in Brryl is as complete as possible.

Compulsory insurance

Compulsory third party liability insurance covers up to 35 million lek per event for high-risk entities and up to 50 million lek for very high-risk entities. It includes damages to people and property of third parties, customers, passers-by, pedestrians, neighbors. 

According to point 4 of Article 9 of Law No. 32/2016, “On guaranteeing the safety of the operation of pressure equipment and installations”, economic operators that own or manage pressure equipment and installations must have civil liability insurance.

This insurance is a separate product from insurance companies.

Insurance, for companies, must be valid throughout the entire period of use of the equipment or installation and serves to cover damages that may be caused to the environment, life, health and property of citizens.

The law considers "pressure equipment" to be stationary equipment, simple vessels and pressure transport equipment, with a permitted pressure above 0.5 bar.

In this sense, fuel sales points are also subject to this legal obligation.

According to the Council of Ministers Decision No. 268/2024, which defines the categories of economic operators that own or manage equipment or installations under pressure, fuel points must have a civil liability insurance contract depending on the storage capacities.

Voluntary insurance, to minimize damages from other risks

There are four other voluntary insurances: 

1. Personnel insurance against accidents, 

2. Property insurance as a business, 

3. Insurance of missing profit

4. Environmental damage insurance. 

Personnel accident insurance covers medical expenses and injuries to employees. In the event of death, depending on the contract, compensation can go up to 5 million lekë. This insurance costs between 9-16 thousand lekë per year depending on the coverage and the difficulty of the work.

Property insurance helps to cover material damages and restore business activity. For 1 euro per square meter, property damage resulting from events stipulated in the insurance policy will be covered by the insurance company.

Loss of profit insurance compensates for losses resulting from material damages, income resulting from the event. Compensation is based on the company's official balance sheets.

Environmental liability insurance covers environmental damage and the financial liabilities that arise from it.
