Former President Joe Biden's recordings of interviews with the writer who helped prepare his memoirs - taken during special counsel Robert Hur's investigation into classified documents - have been made public.
After a months-long legal battle by Biden's lawyers to block the release of the recordings, they dropped their lawsuit and asked for the case to be dismissed on Friday, which a judge granted on Monday.
The plaintiff, Mike Howell, a former employee of the conservative Heritage Foundation and now part of the Oversight Project, had fought for more than two years to obtain the materials through Freedom of Information Act (FOIA) requests. He argued that the public had a vested interest in seeing the recordings and transcripts on which Robert Hur based his decision.
The Oversight Project released hours of recordings of Biden's conversations in 2016 and 2017 with his memoirist, Mark Zwonitzer, in which the former vice president frequently pauses, speaks with difficulty and has trouble remembering events - reinforcing the description of special counsel Robert Hur in his report.
“Joe Biden didn’t want these records to come out. But now they are – after two years of painful delay. There is no joy in the Biden camp today. The decision by Robert Hur and Merrick Garland to grant Biden a waiver to withhold and disclose classified information must be reviewed from beginning to end,” said Jeff Clark, vice president of litigation at the Oversight Project.
The House Judiciary Committee announced that 2 hours and 45 minutes of recordings have been released.
Hur investigated Biden's handling of classified documents from his time as a U.S. senator from Delaware and vice president in the Obama administration. He decided not to pursue criminal charges because he concluded that prosecutors could not prove beyond a reasonable doubt that Biden intentionally withheld or disclosed the materials.
In his report, Hur wrote that Biden's conversations were "extremely slow" and that Biden was "having difficulty recalling events and sometimes straining to read and follow his personal notes."
"Mr. Biden's memory was clearly limited, both during the recorded interviews with the memoirist in 2017 and during the interview with our office in 2023," Hur wrote.
He also said that, as a reason for not prosecuting, Biden could be presented to a jury as “an elderly, charming, well-meaning man with a poor memory,” rather than as someone who had knowingly violated the laws on classified documents.
The recordings show instances of Biden taking long pauses, forgetting names and failing to remember certain dates.
During a conversation about a Situation Room meeting in 2014, Biden warned Zwonitzer: “Some of this may be classified, so be careful,” and added: “I’m not sure. It’s not marked as classified, but…”
On one occasion, on April 24, 2017, Biden had difficulty remembering the names of two economic advisers.
"I'll remember his name," Biden said, and then: "I have to write down the names, because I keep forgetting them."
After that there was a long pause, until Zwonitzer mentioned the name Alan Krueger.
That same day, Biden couldn't remember where he was on a certain date. He later recalled being at a memorial service for a fallen soldier but forgot his name.
Biden said: "I think I went to that memorial service in Wilmington. It says [name deleted] on December 4th, but I don't... I don't know what that means. Memorial service - [names deleted] is really confusing to me."
Zwonitzer replied, "Okay," and Biden said he would "mark that down as well."
"But anyway, let's go back to - it was... I had a meeting with Ron Klain, and I don't know when it was," Biden added.
Biden also seemed to have difficulty remembering a lunch with former US Treasury Secretary Larry Summers.
"When he came to me – and I'll find the date. Remember, when Summers came to have lunch with me – that's when I was thinking about running."
He then continued: "Here's what happened, before I forget. Don't worry about my train of thought. He also promised to support me in 2016."/ By Ashley J. DiMella, FOX NEWS
