Kosovo Judicial Council asks Haxhiu to dismiss resigned Serbian judges

The Kosovo Judicial Council has asked the acting president, Albulena Haxhiu, to dismiss judges and support staff from the Serb community who had requested their return to work after collectively resigning years ago.

Their request to return to work was reviewed by the Judicial Council on Thursday morning, where its members voted to reject it.

"By majority vote, the KJC has decided to reject the request for the withdrawal of the judges' resignations and has decided to propose to the President of the Republic of Kosovo the release of the judges from office," the Judicial Council said in a statement.

Meanwhile, the acting president, Haxhiu, said she welcomes the decision of the Judicial Council and announced that "in accordance with constitutional and legal responsibilities... I will take action to relieve them of their duties."

Haxhiu, together with the acting Prime Minister, Albin Kurti, had previously pushed the Judicial Council to come up with such a request, despite calls from the European Union not to put pressure on the independent judicial institution.

The decision comes after last month, Haxhiu dismissed seven Serbian prosecutors who had resigned at the end of 2022.

Around 130 judges, prosecutors and administrative employees of the justice system had resigned at the end of November 2022, as part of the collective departure of Serbs from Kosovo institutions in the four Serb-majority municipalities in the north - North Mitrovica, Leposavic, Zvecan and Zubin Potok.

This action - instigated by the Serbian List, the largest Serb party in Kosovo, which is supported by Belgrade - came in protest against the Kosovo Government's decision to remove Serbian-issued vehicle license plates from use and replace them with Kosovo license plates.

The EU has called for the issue of the reintegration of resigned Serbian judges and prosecutors to be resolved within the framework of the dialogue between the two neighboring countries, but Kosovo wants to release them from office and fill their places through new competitions for Serbian judges and prosecutors.

Kosovo authorities have insisted that the return of Serbs to Kosovo institutions cannot be a political issue, but must be treated as a legal and constitutional issue. /REL
