"It's not your place to prejudge the case against him," Thaçi's lawyer responds to Marta Kos

Hashim Thaçi's lawyer, Luka Misetic, has reacted to the statement of the European Commissioner for Enlargement, Marta Kos, who, after the decision against the former leaders of the Kosovo Liberation Army, stated that the Specialist Chambers are an "impartial and independent judicial body."
She wrote that the decision is about "individual responsibility and justice for victims and their families from all communities in Kosovo."
Misetic has objected to the way Kos has characterized the Special, saying that its impartiality in the Thaci case has not yet been determined.
“Whether the Kosovo Specialist Chambers acted impartially in the Thaçi case remains to be determined. It is not for Marta Kosi to prejudge this issue,” Misetic wrote, adding a report by the Lawyers’ Committee for Human Rights of England and Wales that, he said, questions the impartiality of the trial judges.
The Committee in its report identified serious problems in the protection of procedural guarantees, particularly in relation to the right to a fair, transparent and impartial trial of the Special Court. Among other things, it found that the mandate of the Special Court had deviated from its original purpose.
Commissioner Kos had requested on September 16 that the decision of the Specialist Chambers for the KLA four be respected.
