Tender with AKSHI clients, CEC allegedly disqualified a company for a fabricated reason, APP blocks the procedure and requests official evidence

The Central Election Commission (CEC) is at the center of suspicions of manipulation of public competitions, after the Public Procurement Agency (APP) criticized the evaluation made by the Bid Evaluation Committee (KVO) for the tender with the object of "Maintenance of existing CEC modules".

Through the official letter of the Legal Directorate of the Public Procurement Agency, provided by VNA, an account is requested because the CEC's claims that the economic operator "Instant.Al" Shpk has submitted "false data" do not match the actual factual verifications.

According to the letter, the CEC had disqualified the company "Instant.Al" Shpk claiming that the documentation (diplomas and certificates) submitted on behalf of the expert Mr. Granit Gjana contained false data. On this basis, the CEC had addressed the PPA to initiate administrative proceedings to exclude this company from the right to win public contracts.
However, the PPA has debunked these claims after direct verification:

"From the verifications carried out by the APP, regarding the certificates and Diploma presented by the economic operator 'Instant.Al' Shpk... as well as the scanning of the QR code contained in these documents, they resulted in the name of Mr. Granit Gjana".

After the CEC claimed that its assessment was based on the factual situation verified during the review, the PPA recalled the legal norms and imposed strict conditions:

"Every request submitted to the PPA by third parties must be accompanied by supporting documentation. When the documentation submitted under this point is incomplete, the PPA returns it for completion...".

The procedure remains open and the decision to exclude the company has not been approved by the PPA.
The PPA has rejected the current request of the CEC to penalize the operator and has left the task to the contracting institution to:

To conduct genuine, official and verifiable verifications with the issuing company "Alison" itself to verify whether or not the diploma certificates were issued by it.

Only if this official verification results in fraud, the CEC must forward the evidence within 3 days to the PPA, translated, notarized, and certified with a green seal.

If the CEC does not provide this official evidence, its request to penalize the company will be considered ultimately unsubstantiated.

Tender value: The limit fund of this procedure is 42,972,173 lek excluding VAT (approximately 466,000 euros).

*Who is "Instant.Al" Shpk?*
According to the commercial register (CKB), the company "Instant.Al" Shpk has as its owner and administrator Emerlinda Gjana. The person against whom the claims for the certificates were raised, Mr. Granit Gjana, appears as an expert / Data Protection Officer at this company.

After the disqualification of the lowest bid from "Instant.Al" Shpk, the qualification and announcement of the winner leaned towards the company "FIRST" Shpk. Ultimate owner / Controller of "FIRST" Shpk: The company is owned by businessman Gëzim Hoxha (who also happens to be the brother of former diplomat / senior official Ferit Hoxha). His name and the companies related to him have been in the focus of investigative media and verifications on public contracts in the IT field, especially for the AKSHI tenders and the role of Gys Agas. / VNA
