Conflict over Vlora Airport, Pacolli gives Rama 6 months to not take the matter

Businessman Behgjet Pacolli has reacted again regarding the Vlora Airport issue, stating that the MABCO company has been prohibited from making decisions at the VIA company and from exercising the rights that stem from its ownership.

In a Facebook post, Pacolli writes that MABCO, which owns 98% of the shares, has been prevented from exercising its rights as a shareholder since last year. According to him, this situation has also contributed to the blockage of works at Vlora Airport.

The businessman further emphasizes in his post that since efforts to find a solution have been exhausted, MABCO has sent a "Notice of Dispute" to the Albanian state authorities, which according to him is in accordance with the Bilateral Agreement between Switzerland and Albania for the promotion and reciprocal protection of investments.

According to him, both parties have a six-month period to resolve their differences through dialogue. He also emphasizes that his company has made continuous efforts to find a solution, but has not received a response.

Pacolli further underlines that his company will respect the six-month period, in the hope that the Albanian authorities will engage constructively to resolve the "dispute" and avoid arbitration.

" MABCO remains ready for dialogue and for a just and sustainable solution. However, the possibility of avoiding further escalation of this "dispute" now depends on the readiness and willingness of the authorities of the Republic of Albania to engage constructively in this process ," he emphasizes in his post.

Starting from the fact that, since last year, MABCO has been, and still remains, DEPRIVED from any effective access to the decision-making process of the VIA enterprise, and has been prevented from exercising the rights arising from its ownership of 98% of the shares as a direct consequence of the actions and inactions of the Contracting Authority and other competent authorities.

This situation has also directly impacted the blockage of works at the Airport, as in fact, since April 2026, MABCO has been deprived of access to the spaces and facilities that were built through the company's own staggering investments, making it impossible in practice to administer, protect and utilize its investment.

After efforts to find a solution through other means have been exhausted, MABCO has sent a “Notice of Dispute” to the Albanian state authorities in accordance with the Bilateral Agreement between Switzerland and Albania for the promotion and reciprocal protection of investments (BIT).

Currently, the case is in a six-month "cooling-off" period, designed to give the parties the opportunity to resolve the dispute through dialogue and negotiations to avoid INTERNATIONAL ARBITRATION, ICSID, at the WORLD BANK in Washington.

Throughout this period, MABCO has continuously called on the authorities of the Republic of Albania for constructive dialogue and to find a reasonable solution. Unfortunately, to date, these calls have not received a concrete response.

Despite this, MABCO will fully respect the period foreseen by the relevant legal framework, in the hope that the Albanian authorities will engage constructively to resolve the "dispute" and avoid the last resort, namely international arbitration.

MABCO remains open to dialogue and a just and sustainable solution. However, the possibility of avoiding further escalation of this “dispute” now depends on the readiness and willingness of the authorities of the Republic of Albania to engage constructively in this process. BP
