Lawsuit against Trump for sanctions against The Hague Tribunal

In February 2025, the US administration under Donald Trump imposed sanctions on representatives of the International Criminal Court (ICC) based in The Hague, Netherlands.
Now, several human rights groups have filed a lawsuit against US President Donald Trump over his actions against the court. The lawsuit, filed in a New York court, says the Trump administration's sanctions on court officials are preventing war crimes victims from receiving justice.
Among the US government sanctions against representatives of the International Criminal Court (ICC) were a ban on entry into the US of several ICC judges and prosecutors, as well as measures to freeze their assets in the United States.
The main reason was the court's investigations and arrest warrants against senior Israeli officials, including Prime Minister Benjamin Netanyahu , in connection with the war in the Gaza Strip.
Four human rights organizations, including Human Rights Watch, are seeking in their lawsuit the repeal of these sanctions, arguing that they violate laws, such as those protecting freedom of expression.
The US wants to weaken the International Criminal Court
The more than 100-page lawsuit states: “This is an unlawful abuse of power, which constitutes a direct attack on the rule of law, on the independence of judges, prosecutors and lawyers, on the fundamental principles of the international legal order and on the principle of equal access to justice.”
According to the lawsuit, the imposed sanctions make it difficult to prosecute cases of genocide, war crimes and human rights violations.
The International Criminal Court, established in 1998, has been prosecuting crimes such as genocide, war crimes and crimes against humanity since 2002. More than 120 states have recognized the court's legal basis through its founding treaty. The United States and Israel are not among them.
Last month, US Secretary of State Marco Rubio said in a video message that the US would pressure other countries to withdraw from the International Criminal Court. /DW
