The blockade of the Kosovo Parliament may return again

If a political agreement is not reached in the coming period for the election of the Deputy Speaker of the Kosovo Assembly from the Serbian community, the institutional blockade may return during efforts to form the new institutions.
This is what Kadri Kryeziu, a former judge of the Constitutional Court of Kosovo, told Radio Free Europe, emphasizing that this is now a political issue, not a legal one.
Vullnet Bugaqku, from the Democratic Institute of Kosovo, does not rule out the possibility of a new institutional blockade, as representatives of the Vetëvendosje Movement, according to him, "interpret the Constitutional Court's decision differently."
"I do not exclude the possibility that they could very easily grab onto a word, part of the text or any provision of the decision and intentionally interpret it incorrectly, just as they did during the 56 sessions of the constitution of the Assembly last year," Bugaqku tells Radio Free Europe.
On January 28, the Constitutional Court of Kosovo found that the election of Nenad Rašić as Serbian Deputy Speaker of the Assembly in the previous legislature, made through a draw, was not in accordance with the Constitution and the Rules of Procedure of the Assembly.
The court emphasized that the right to nominate a candidate belongs to the party that has won the majority of seats reserved for the Serb community - in this case, the Serbian List, which had nine out of ten mandates.
This party - the largest of the Serbs in Kosovo, which has the support of Belgrade - won nine seats again in the early parliamentary elections on December 28, while Nenad Rašić, leader of the Party for Freedom, Justice and Survival, won one seat.
The institutional blockade could return if Albin Kurti's Vetevendosje Movement, which won the last elections, continues to refuse any cooperation with the Serb List, while the Serb List refuses to nominate Rašić.
The Serbian List believes that Rašić entered the Kosovo Assembly with the support of the acting Prime Minister, Albin Kurti, and considers him an "illegitimate" representative of Serbs.
Is there a chance for an agreement?
Radio Free Europe/Radio Liberty requested comment on the Constitutional Court's decision and the possibility of an agreement from both Nenad Rašić and the Serbian List, as well as the Vetëvendosje Movement, but, by the time of publication of this article, had not received any response.
Mimoza Kusari Lila stated to Tevë 1 that the parliamentary group of the Vetëvendosje Movement, of which she is a member, will not vote for the candidates of the Serbian List until all details of the full decision of the Constitutional Court are reviewed and the proper way of electing the Deputy Speaker of the Assembly from the Serbian community is determined - including candidate Nenad Rašić.

Bugaqku i vlerëson deklaratat e Kusari Lilës si “tërësisht të paqëndrueshme dhe të gabuara” dhe thekson se dy vendimet e fundit të Gjykatës Kushtetuese ishin të qarta.
Sipas tij, Gjykata sqaroi se bllokada në konstituimin e Kuvendit nuk u shkaktua nga mospropozimi i kandidatëve nga Lista Serbe, por për faktin se deputetët nga komuniteti shqiptar nuk votuan.
“Gjithashtu, sipas Gjykatës Kushtetuese, nuk e kanë respektuar as aktgjykimin, as Kushtetutën dhe as vetë rendin kushtetues të Republikës së Kosovës, duke mos votuar kandidatët që janë propozuar nga grupi që është shumicë e komunitetit serb”, thotë Bugaqku.
Ai shton se deputetët shqiptarë nga të gjitha partitë politike në Kuvend, nuk kanë të drejtë të diktojnë se si do të përfaqësohet një komunitet në Kryesinë e Kuvendit.
Kosova u përball me një krizë të thellë institucionale dhe politike pas zgjedhjeve të 9 shkurtit të vitit të kaluar, pasi partitë shqiptare nuk arritën të binin dakord për zgjedhjen e kryetarit të Kuvendit - gjë që u pasua nga një bllokadë për zgjedhjen e nënkryetarit nga komuniteti serb.
Zgjedhjet e parakohshme u shpallën pasi dy kandidatë nga Lëvizja Vetëvendosje - Albin Kurti dhe Glauk Konjufca - nuk arritën të siguronin numrin e mjaftueshëm të votave për të formuar Qeverinë e re.
Partitë janë drejtuar disa herë në Gjykatën Kushtetuese, por, sipas Bugaqkut, mbetet ende e paqartë se çfarë pasojash ligjore do të kenë deputetët, nëse Kuvendi nuk konstituohet brenda afatit ligjor prej 30 ditësh.
Aktualisht, vazhdon rinumërimi i votave nga zgjedhjet e 28 dhjetorit dhe pas përfundimit të procesit, pritet të nisë krijimi i institucioneve të reja.
Më herët, Lëvizja Vetëvendosje ka kërkuar nga Gjykata Kushtetuese që kërkesat e Listës Serbe lidhur me konstituimin e Kuvendit, të shpallen të papranueshme.
Lideri i Vetëvendosjes, Albin Kurti, ka deklaruar gjithashtu se Gjykata Kushtetuese vepron në mënyrë të njëanshme, duke favorizuar partitë shqiptare që kanë qenë në opozitë.
Gjykata Kushtetuese ka reaguar, duke theksuar se pavarësia dhe paanshmëria e saj janë të garantuara me Kushtetutë dhe se asnjë institucion, parti politike apo individ nuk mund të ndërhyjë në punën e saj.
